A U.S. District Court judge has dismissed in part a federal lawsuit against Rehoboth Beach brought about by the city's pool moratorium. Judge Leonard Stark dismissed due process claims brought against the city by E&R Enterprises, but he allowed the case to be remanded back to Delaware Court of Chancery to litigate E&R's claims that the city violated their property rights.
