DNREC, DDA prepare to respond to Delaware Supreme Court?s Dec. 7 decision allowing firearms in state parks and forests

DOVER – The Delaware Supreme Court, by decision dated Dec. 7, 2017 in the matter of Bridgeville Rifle & Pistol Club, LTD, overturned a Superior Court ruling and ended a ban on visitors' possessing firearms in Delaware's state parks and state forests. Pursuant to the ruling, visitors may now possess firearms unless they are prohibited by law due to a past conviction for a violent crime, active Protection from Abuse Order, or mental health commitment. Following the Court's decision to invalidate the existing regulations limiting firearms in state parks and forests, and some Division of Fish & Wildlife properties, the Delaware Department of Natural Resources and Environmental Control and the Delaware Department of Agriculture (DDA) anticipate issuing interim firearm regulations. The interim regulations would respect the State Constitutional provisions on firearms cited by the Court, by implementing the State's interest in ensuring the safety of the public in a less restrictive manner.

Raccoon in Rehoboth Positive for Rabies; Public Health Warns Residents of King?s Creek Area

Delaware's Division of Public Health (DPH) is warning residents of the King's Creek community and surrounding areas in Rehoboth Beach of a positive case of rabies in a raccoon who bit a human last week. The raccoon was captured and brought to the DPH Lab, where test results confirming it had rabies came back on Wednesday, Dec. 13, 2017. The victim, who was putting up holiday decorations in his yard, was bitten by the raccoon who was hidden in some bushes. The individual has begun treatment for the bite.

MAGNOLIA – A DNREC Fish & Wildlife Natural Resources Police investigation culminated Dec. 4 with the arrest of a Magnolia man for multiple deer hunting violations and charges related to possession of firearms, deadly weapons, and ammunition by a person prohibited. Public Health Closes Illegal Tattoo Operation in Selbyville

On Tuesday Nov. 28, 2017, the Delaware Division of Public Health (DPH) ordered closure of an unpermitted body art establishment operating out of a barbershop in Selbyville. In addition to operating without a permit and being entirely unregulated, DPH staff were unable to confirm that proper sanitary precautions were used. DNREC updates information on nitrate levels found in water at private residences near Mountaire Farms? Millsboro poultry plant

MILLSBORO – The Department of Natural Resources and Environmental Control is working with the Delaware Division of Public Health to sample water from wells at private residences in the vicinity of Mountaire Farms' Millsboro poultry processing plant that was recently cited by DNREC for wastewater violations involving excessive levels of nitrates. Water in several wells sampled earlier this month was found to contain nitrates in exceedance of the national drinking water standard of 10 milligrams per liter (10mg/L).

Compliance with Delaware forest harvest law protects water quality

Delaware timber harvests achieved a 93 percent rate of compliance with best management practices (BMPs) designed to protect water quality and limit soil erosion, according to a new report. Dr. Anne Hairston-Strang, a forest hydrologist with the Maryland DNR Forest Service, assessed the use and effectiveness of BMPs by surveying a total of 72 sites in Maryland and Delaware from 2014 to 2016. Selected sites were locations with waterway crossings and buffers with the greatest potential for water quality impacts. Effects were expected to be larger than normal because high rainfall during the 2014-2016 period represented an increase of 20 percent above the 30-year average. Final data indicated that the average sediment delivery across all locations was less than one cubic foot per site—indicating that proper use of BMPs was successful at protecting water quality during harvest operations.

In the 15th Prescription Drug Take-Back Day event on Oct. 28, Delaware collected 5,518 pounds of unwanted or expired medicine according to the U.S. Drug Enforcement Administration (DEA) and the Division of Public Health (DPH). Since the first event in May 2010, Delaware has collected a total of 76,474 pounds of unwanted or expired medicine.

Delaware and DNREC observe America Recycles Day, with state?s recycling exceeding the national average

DOVER – Today is America Recycles Day, and Delaware has a lot to celebrate, including the state's 44.5 percent recycling diversion rate – 10 percent above the national average – for keeping recyclable materials out of landfills. The diversion rate has almost doubled since 2006, when the Recycling Public Advisory Council (RPAC), Delaware Solid Waste Authority (DSWA) and the Department of Natural Resources and Environmental Control (DNREC) started calculating recycling rates in Delaware.

DNREC to hold workshops Nov. 29 and 30 seeking public input on Coastal Zone Conversion Permit Act regulatory development process

DOVER – Delaware's Department of Natural Resources and Environmental Control will hold two public workshops this month seeking input as DNREC begins the regulatory process for developing regulations for the Coastal Zone Conversion Permit Act, which Governor John Carney signed into law in August. The act requires the Department to develop and promulgate regulations for the redevelopment of 14 heavy-industrial use sites in Delaware's Coastal Zone by Oct. 1, 2019. The workshops will provide the public an opportunity to comment on the process the Department will use to develop regulations for the conversion permits DNREC will issue for sites to be redeveloped.

2017 DNREC?s Delaware Coastal Cleanup drew 1,500-plus volunteers who collected 3.8 tons of trash

This year's DNREC-sponsored 30th annual Delaware Coastal Cleanup held Sept. 16 drew 1,567 volunteers, who collected 3.8 tons of trash from 47 sites along more than 75 miles of Delaware's waterways and coastline stretching from Wilmington to Fenwick Island. About one-quarter of that trash was recyclables – mostly aluminum cans and glass and plastic beverage bottles.

DNREC's Division of Energy & Climate has awarded a total of $245,000 in grant funding to the cities of Wilmington and Newark, and the towns of Frederica, Milton, and Fenwick Island through the Sustainable Communities Planning Grant Program. The grants support the creation of local sustainability plans that will ultimately serve over 100,000 Delaware residents. 31 Severely Neglected Animals Rescued in Seaford

On Sunday, October 8, 2017, the Division of Public Delaware Office of Animal Welfare received a tip about a property in the Seaford area with neglected animals. Delaware Animal Services (DAS), the state's animal control and cruelty enforcement unit, found approximately 43 dead dogs and took into custody another 32 animals, including 31 dogs and a cat.

7th Annual Arborist and Tree Care Seminar on Oct. 30 and 31 at State Fairgrounds in Harrington

The Delaware Forest Service's urban and community forestry program will hold its 7th Annual Delaware Arborist and Tree Care Seminar—a one and a half-day seminar on October 30 and 31, 2017 at the Delaware State Fairgrounds Exhibit Hall.
